Who is your typical client?

Our typical clients range from sole proprietors or small startups who just wants to make sure they are covered legally to mid-sized, closely held companies that need legal advice but don’t have the need for a full-time, in-house legal department. Most of our business comes from referrals from our existing clients.

We also have clients who come to our office for one legal matter and then later return when they need something else – for example, we had a client who came to us for a patent application, who then needed a licensing agreement, and later some help with estate planning and business transition work for his small, closely held business. We are always available to help our clients, even if it is just to find another attorney who specializes in a particular area.

How much is your hourly rate?

Hourly rate ranges from $360 to $600 per hour and our associates range from $180 to $300. We also have paralegal and law clerks that range from $60 to $180 per hour.

How do you request payment?

We take both checks and credit cards. We understand that many people believe they cannot afford legal help, so we believe in payment flexibility and will always try to work with our clients to create the best payment plan for their circumstances.

Do you require a retainer deposit?

Yes, we believe it is important for the client to also have “skin in the game.”  Generally, we seek a minimum of $500.00 deposit for simple matters up to $5000.00 for a patent. This money is kept in a special IOLTA account and you will always have time to review your bill before any money is transferred to us in payment.

Do you do contingent fees?

Yes, we occasionally do contingent fee arrangements, although it is not something we favor as very often these are only done in litigation or trial situations where the outcome is uncertain.

What is your approach to winning or representing a case?

We will represent you zealously, but ethically. Each case or issue is unique and each may require a different approach or method. We believe in negotiation and resolutions that don’t punish opponents, but if it is necessary to seek tougher action we will do so.

What happens if I am not satisfied with the outcome?

We cannot guarantee any outcome, and you should not ask for one either. We do our best to ensure that you receive the best legal representation possible, that you are satisfied during the process, and we work to achieve a positive outcome for your legal issue.

If it is a situation where you don’t believe we are representing you well you can always ask to have your file transferred.  We seek to be your honest advocate even if it goes against our interest because after all, we want you to have the best possible representation and to help you resolve your issue.

How long have you been a lawyer?

Dave has been licensed to practice as an attorney since 1972, and has been a member of the U.S. Patent Bar since the late ‘90’s. He is licensed in both the States of Texas and Louisiana as well as to the International Court of Trade and the Federal District Courts of Texas. Moira has been licensed since 2008 in California, and was later also admitted to the State Bars of Texas (2009) and New York (2008). Jarad has been licensed in Texas since 2011. How will we communicate?

We use phone, e-mail, virtual conferencing, or text depending on what you as the client feel most comfortable with. If you wish to speak to us in person we can certainly travel to your office or meet you somewhere you prefer, or you can schedule a meeting with us at our offices located at The Cannon Houston.

Who does the work? A paralegal?

A paralegal will often assist the attorneys in setting up the files and doing the administrative work and court filings, where possible.  We also have law clerks who perform research for us on specific legal matters. Otherwise, the work will be performed by the attorney whose expertise and skill set fits the needs of the client.  We work collaboratively in our office and endeavor to give you the best value as well as the best expertise for your needs.

Will you go to trial?

Only if necessary.  Trials take a lot of your money, time, and energy and often, even if you win your case, you do not get what you wanted when you went into the trial. That said, sometimes it is the only way to get your matter resolved.
